حقوق اجتماعی در درخواست‌های فردی به دیوان اروپایی حقوق بشر و دادگاه قانون اساسی (ترکیه): تحلیلی در زمینه حق احترام به زندگی خصوصی و خانوادگی

Despite their crucial role in terms of human dignity, social rights are marginalised compared to civil rights and are considered non-justiciable. On the other hand, the interdependent nature of human rights allows social rights to be protected to a certain extent within the framework of the strong protection systems provided for civil rights. Indeed, although the individual application mechanisms under the European Convention on Human Rights and the Turkish Constitution are primarily concerned with civil rights, they sometimes allow for the indirect protection of social rights. This study examines the indirect protection of social rights within these two mechanisms in the context of the right to respect for private and family life, using a comparative and case-law-based method and drawing on international social rights instruments.
