The spontaneous evolution of the technical framework with the appearance, alongside ‘traditional’ forms of administrative decisionmaking automation, of ‘advanced’ forms of automation by means of artificial intelligence, makes it no longer possible to avoid a serious reflection on the ‘reserve of humanity’, by which is meant the minimum sphere of the exclusive prerogative of the human being, which the latter is destined to perform in the exercise of administrative functions.Its delimitation passes through theoretical-dogmatic considerations regarding the organization and the legal nature of software and inevitably pushes the front of analysis from the procedure to the trial.
