Organization of Innovation: East-West Perspectives (de Gruyter Studies in Organization)

Ziel der Arbeit ist es, sowohl die rechtstheoretisch bereits erörterten wie auch die in der Praxis bekannt gewordenen Probleme zu deuten und systematisch begründete Lösungsvorschläge zu entwickeln. Darüber hinaus sollen bisher nicht diskutierte Fragen der Verzahnung des Strafrechts mit dem Richterrecht aufgezeigt werden. Mit dem Europarecht und der deutschen Strafrechtsdogmatik schneiden sich zwei rechtstheoretisch fremdelnde Kreise, da das Europarecht stark von einer fallorientierten, mehr dem angloamerikanischen Rechtskreis als der deutschen Strafrechtsdogmatik verwandten Rechtsprechung des Europäischen Gerichtshof (EuGH) geprägt wird. Im einzelnen werden die Vielfalt der Einwirkungsweisen des Richtlinienrechts und das Instrumentarium des Richtlinienrechts dargestellt. Es folgen grundsätzliche Vorfragen des Verhältnisses des Strafrechts zum Gemeinschaftsrecht. Dabei geht es um die innerstaatliche Geltung und Anwendbarkeit des Gemeinschaftsrechts und um die spezifische Aufteilung der Rechtsetzungskompetenzen zwischen der Gemeinschaft und den Mitgliedstaaten auf dem Gebiet des Strafrechts. Ausführlich widmet sich die Arbeit der richtlinienkonformen Auslegung des Strafrechts. Der Autor untersucht den Einfluß europäischer Richtlinien gemäß Art. 249 Abs. 3 EGV auf das nationale Strafrecht.
