'Fair and Equitable Treatment' in International Investment Law (Cambridge Studies in International and Comparative Law, Series Number 83)

معرفی کتاب «'Fair and Equitable Treatment' in International Investment Law (Cambridge Studies in International and Comparative Law, Series Number 83)» نوشتهٔ Roland Kläger, Roland Kläger، منتشرشده توسط نشر Cambridge University Press (Virtual Publishing) در سال 1996. این کتاب در فرمت pdf، زبان انگلیسی ارائه شده است.

A breach of fair and equitable treatment is alleged in almost every investor-state dispute. It has therefore become a controversial norm, which touches many questions at the heart of general international law. In this book, Roland Kläger sheds light on these controversies by exploring the deeper doctrinal foundations of fair and equitable treatment and reviewing its contentious relationship with the international minimum standard. The norm is also discussed in light of the fragmentation of international law, theories of international justice and rational balancing, and the idea of constitutionalism in international law. In this vein, a shift in the way of addressing fair and equitable treatment is proposed by focusing on the process of justificatory reasoning. Descripción del editor: "The three main themes of this book, probability theory, differential geometry, and the theory of integrable systems, reflect the broad range of mathematical interests of Henry McKean, to whom it is dedicated. Written by experts in probability, geometry, integrable systems, turbulence, and percolation, the seventeen papers included here demonstrate a wide variety of techniques that have been developed to solve various mathematical problems in these areas. The topics are often combined in an unusual and interesting fashion to give solutions outside of the standard methods. The papers contain some exciting results and offer a guide to the contemporary literature on these subjects.
