Ist ein Dritter am Rechtsverhältnis der Parteien beteiligt, haben diese weiterhin das Interesse, die gerichtliche Zuständigkeit im internationalen Rechtsverkehr vorherzusehen. Die Wirkung einer Gerichtsstandsvereinbarung muss sich dafür auch auf Dritte erstrecken. Eine rechtsklare Lösung der Drittwirkungsproblematik ist jedoch herausfordernd, da eine einheitliche prozessuale Wirkung vielfältigen Drittverhältnissen des nationalen Rechts gegenübersteht. Ziel der Arbeit ist, die Probleme aus der Verflechtung materieller und prozessualer Rechtsverhältnisse aufzuzeigen und zur Entwicklung eines rechtssicheren autonomen Systems der Drittwirkung beizutragen. Auf Basis der Prinzipien der EuGVVO wird ein Rechtssatz zur Drittwirkung aufgestellt, der sodann auf das Europäische Erb- und Familienrecht übertragen wird.»The Third-party Effect of Jurisdiction Agreements in European Civil Procedure Law«: If a third party is involved, the parties still have the interest to foresee the jurisdiction in international legal relations.
