Demetrii Chomateni Ponemata diaphora : [Das Aktencorpus des Ohrider Erzbischofs Demetrios. Einleitung, kritischer Text und Indices]

The author, well-known as an outstanding Byzantine canonist, was Archbishop of Ohrid (approx. 1216–1236) and practically assumed the position of a Patriarch. The Corpus of the Pone-mata diaphora (personal and official letters, expert testimonies and verdicts and proceedings of the Ohrid Synodal Court) is his major work. It pro--vides complex source material of major importance in two ways: historically because of the detailed information on the political and ecclesiastical history of South-Eastern Europe at the time of radical change around 1204; legally because texts (let alone corpora) dealing with the practice of ecclesiastical jurisdiction in Byzantium are few and far between. This new edition replaces the older, non-critical, edition by Cardinal Pitras from 1891. Demetrios Chomatenos, bekannt als herausragender byzantinischer Kanonist, nahm als Erzbischof von Ohrid (ca. 1216-1236) im Teilreich von Epeiros gleichsam die Stellung eines Patriarchen ein. Das Corpus der Ponemata diaphora (ca. 150 persönliche und amtliche Briefe, gutachtliche Responsen sowie Urteils- und Beschlußprotokolle des Ohrider Synodalgerichts) ist sein Hauptwerk. Es gilt in doppelter Hinsicht als Quellenkomplex ersten Ranges: historisch wegen seiner hohen Informationsdichte zur politischen und kirchlichen Geschichte Südeuropas in der Umbruchszeit nach 1204; rechtshistorisch, weil Texte (und erst recht Corpora) zur Praxis kirchlicher Gerichtsbarkeit und Rechtsprechung in Byzanz generell äußerst rar sind. Die vorliegende Ausgabe, die die ältere, unkritische Edition von Kardinal Pitras von 1891 ersetzt, enthält eine umfangreiche Einleitung (Prolegomena). In deren Mittelpunkt steht nach den einleitenden Abschnitten zur Biographie und zur Überlieferung des Gesamtwerks des Erzbischofs eine ausführliche inhaltliche, formale und chronologische Analyse der Ponemata diaphora. Außer regestartigen, besonders bei juristischen Sachverhalten sehr detaillierten Inhaltsangaben bietet sie auch alle notwendigen Hinweise zur (meist nur erschließbaren) Datierung einer jeden Akte sowie deren jeweilige, spezielle Bibliographie. Am Schluß der Prolegomena wird die handschriftliche Grundlage der Edition geklärt (Recensio). Die Ausgabe wird durch vier Indizes (Eigennamen, incl.
