Das internationale Zivilprozessrecht ist in Deutschland nicht zusammengefasst geregelt. Die Normen des deutschen internationalen Zivilprozessrechts finden sich verstreut in der ZPO, teilweise auch in anderen Gesetzen. Die für die internationale Rechtsverfolgung wesentlichen Bestimmungen der §§ 110 (cautio iudicatum solvi), 293 (Nachweis und Feststellung ausländischen Rechts), 328 (Anerkennung ausländischer Zivilurteile), 722 f. (Vollstreckbarerklärung ausländischer Zivilurteile), 1061 (Anerkennung und Vollstreckbarerklärung ausländischer Schiedssprüche) und 1067 ff. (Justizielle Zusammenarbeit in der EU) sowie die in der ZPO nicht geregelte internationale Rechtshängigkeit (Anh. zu § 261) sind in der Kommentierung in der 3.
